TikTok Giveaway Rules + Free Template
TikTok giveaway rules fall into two groups: what the platform lets you do, and what the written rules for your own giveaway need to say. Most creators only think about the first. The second is what protects you when someone disputes the result, and it is the part you can copy and fill in once and reuse.
This guide covers both. First, what TikTok allows and what trips giveaways up, then the pieces every set of official rules for a giveaway should contain, then a free template you can paste straight into your post, a link in your bio or a pinned comment.
What TikTok allows in a giveaway
TikTok's published giveaway policy is written mainly for TikTok Shop sellers and creators, so it helps to separate what it says from what applies to everyone.
For Shop giveaways, the policy is specific. Sellers and creators must use the LIVE Giveaway feature on TikTok Shop, with "Join to Win" or "Comment to Win" as the supported formats. Cash, virtual currency and gift cards are prohibited as prizes. Giveaways must not use gambling, gamification or randomisation mechanics such as wheel spins as the entry route. The policy also lists what must be disclosed: the entry method, duration, number of winners, prize details, winner selection process and how the prize is claimed. Sellers are solely responsible for the giveaway and must not imply any affiliation with TikTok Shop. TikTok's US seller policy also caps the value of Shop giveaway items at under $500, though other regional pages do not give a dollar figure. Violations can lead to enforcement action against the account, and sellers can appeal.
For everyone else, the platform rules are less detailed, which makes the general principles more important. TikTok expects giveaways to follow its community guidelines, to be free to enter, and to state the terms in the content. The safe habit is to put the key terms on screen or say them aloud, not only in the caption, since a viewer who cannot see or hear the terms while watching has not seen them. Prize caps can differ between formats, and TikTok updates its policies, so check the current promotions rules before you set a prize value. For a longer walkthrough of the platform side, see the full 2026 guide to TikTok giveaway rules and guidelines.
What gets giveaways flagged or disputed
These are the mistakes that cause trouble most often, whether the problem comes from the platform, entrants or a regulator.
Requiring a purchase to enter. Entry must be free. Do not make people buy something, or send paid LIVE gifts or coins, to qualify.
Promising that everyone wins, or using fake urgency such as "only the next ten comments count". Both mislead entrants.
Demanding long lists of tags or mass sharing. Asking for a friend or two is common. Demanding that people tag ten accounts is the kind of mechanic that gets flagged. If you want to require follows, the guide on whether you can require follows in a TikTok giveaway covers the limits.
Implying TikTok or another company backs the giveaway when it does not. This is why a disclaimer matters.
Using bots, multiple accounts or other ways of inflating entries. Do not ask people to create extra accounts to enter.
Hiding the terms. Rules that exist only in a link nobody can find, or only in a caption, are a common source of complaints.
Choosing the winner in a way you cannot show. Picking by scrolling is hard to defend, and the UK's advertising regulator has upheld a complaint where a promoter said it used an online comment picker but could not show the selection was random.
What official rules for a giveaway must include
Official rules do not need to be long, but they need to cover the same ground every time. A good set includes:
- A statement that no purchase is necessary to enter or win.
- Who can enter: minimum age, countries or regions, and who is excluded, such as employees and their families.
- The name of the sponsor, meaning you or your brand.
- The entry period, with a start and end time and a time zone.
- How to enter, with the exact action and any keyword.
- The prize, its approximate value, and what is not included, such as shipping to some regions.
- How the winner is selected, including that it is random and how many winners there are.
- How and when the winner is notified, how long they have to respond, and what happens if they do not.
- Odds, which depend on the number of eligible entries.
- Taxes and delivery responsibility.
- How you will use entrants' data.
- A statement that the giveaway is not sponsored, endorsed or administered by TikTok.
- Where the winner's name will be shown, or how to ask for it.
The guide to whether you need official rules for a giveaway explains when a short version is enough. If you would rather generate a version for your specific giveaway, the giveaway rules generator builds one from your answers.

Short version for the video
TikTok wants the key terms visible in the content itself, so add a short version on screen or in the spoken script, with a link to the full rules in your bio or a pinned comment:
"[PRIZE] giveaway. To enter: comment [KEYWORD] before [DATE, TIME, ZONE]. One entry per person. Open to [REGIONS], [AGE]+. Winner chosen at random and contacted by DM. No purchase necessary. Full rules: [LINK]. Not sponsored or endorsed by TikTok."
Notes before you publish
Change the template to fit where your entrants live. A few places need extra care:
- In Canada, a winner is usually asked to answer a skill-testing question before the prize is confirmed. The Canadian giveaway rules guide explains it.
- In the UK, the CAP Code applies to how you run and advertise a prize draw. The UK giveaway guide covers what to include.
- In Australia, a permit can be needed above certain prize values in some states. See running a giveaway in Australia.
- In the US, large prizes can trigger registration and bonding in some states, and winners owe tax on prize value. See the guide to whether TikTok giveaways are legal.
- For TikTok LIVE, the rules differ, so check the guide to TikTok LIVE giveaway rules.
This template is general information, not legal advice. For a large prize or a regulated product, have a professional read it.
Follow the rules when you pick the winner
Your rules say the winner is selected at random, so the draw has to match. A comment picker reads the comments on your video, applies your keyword and one-entry-per-person rules, and chooses at random, which lets you show how the draw was done. Record your screen when you run it and keep the result. When the winner is chosen, contact them privately, check the account is real, and then announce them. The guide on how to announce a giveaway winner has formats you can copy.
